SHC disposes of petition of disabled sacked employees of KESC

Karachi: The Sindh High Court SHC division bench headed by Justice Faisal Arab on Monday disposed of the petition with the directions to the Karachi Electric Supply Company KESC and other respondents to consider sacked employees of KESC if they fall eligible for the 2 percent reserved quota for disabled persons.

The petitioners, Sakhawat and other three disabled persons cited Federation of Pakistan through secretary of ministry of law and justice and parliamentary affairs, province of Sindh through secretary social welfare department, Karachi Electric Supply Company KESC through its CEO as respondents.

He said that KESC management has adopted a hostile policy against employees of the company after its privatization and present management sacked permanent employees including petitioners and other more than 50 disabled employees and on their places employees on contract basis were appointed.

He said that after the removal from services they approached to the provincial council for the rehabilitation of disabled persons but council failed to perform the its legal duty of enforcing the implementation of the Ordinance 1981 whereby the government as well as private organization are bound to ensure 2 percent quota of jobs for the disabled persons.

He said that KESC has total number of 9000 employees and therefore under section 10 of the Ordinance 1981 they are bound to appoint at least 180 persons in the company.

He appealed to court to declare the sacking of all the disabled employees including petitioners by KESC as illegal and also declare that KESC is legally bound to employ 2 percent disabled persons.
